Terms of use

1. Acceptance

By downloading, installing or using TrainUp ("the App") you agree to these Terms of Use. If you do not agree, do not use the App. The App asks you to accept them explicitly during onboarding and records which version you accepted; when they change materially, we will present them again.

2. What TrainUp is

TrainUp is a strength-training logging and tracking application. It lets you build routines and programs, log workouts set by set, follow your progress, keep a nutrition diary, and share workouts with friends and discover public posts.

The App works offline: private history is stored on your device. Community, purchases, AI analysis and other online features require a connection. Private history is not automatically restored on another device.

3. Minimum age

You must be 16 or older to use TrainUp. If you are younger, do not create an account.

4. Your account

• The first time you open the App, an anonymous session is created automatically. No sign-up is required to train.
• You can link an email and password at any time to recover your online identity. Private history remains local and is lost if you uninstall or lose the device.
• You are responsible for keeping your password safe and for the activity on your account.
• An account belongs to one person. Do not share or transfer it.

5. Health: what TrainUp is not

TrainUp is not a medical service and does not give medical advice. The numbers you see — volume, estimated 1RM, percentiles, calorie and macro targets, weight or rest suggestions — are automatic calculations or AI estimates from what you enter or photograph. They do not account for your medical history, your injuries or your circumstances.

• Consult a healthcare professional before starting or changing a training or nutrition program, especially if you have a medical condition, are pregnant, or are recovering from an injury.
• Lifting weights carries a risk of injury. You decide what goes on the bar: the App records, it does not prescribe.
• If you feel pain, dizziness or any unusual symptom, stop and seek medical attention.
• Nutrition data for catalogue foods comes from third-party sources and may contain errors. Do not use it for clinical decisions.
• Body and food photo analysis are approximate estimates: they can be wrong, do not diagnose, and must always be reviewed by you.

6. Free plan and TrainUp Pro

Training is free and unlimited. There is no cap on logged workouts, sets or history: your past in the App is never charged for and never trimmed.

The free plan limits organisation and analysis:

Limits are checked at creation time, never retroactively: if your subscription ends, you keep everything you already created; you simply cannot create beyond the free limit.

These limits may change in future. If a change affects you unfavourably while you hold an active subscription, we will tell you in the App with reasonable notice.

7. Subscription and payment

• TrainUp Pro is offered as a monthly or annual subscription, and may be offered as a one-time lifetime purchase. Prices are shown in the App in your currency, inclusive of tax where applicable, and Apple sets them by regional tier.
• Payment is charged to your Apple account when you confirm the purchase.
• Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. Renewal is charged within those last 24 hours.
• A one-time purchase does not renew and is not charged again.
• We do not offer a free trial.

7.1 Managing and cancelling

Subscriptions are managed and cancelled in iOS Settings → your name → Subscriptions, or via the "Manage subscription" button in the App, which takes you there. Cancellation takes effect at the end of the period already paid for: you keep Pro until that date.

7.2 Restoring purchases

If you reinstall or switch devices, use "Restore purchases" in the App. For your purchase to return to your TrainUp account — and not only to your Apple ID — you must have linked an email (section 4).

7.3 Refunds

Purchases are processed by Apple, and so are refunds: request them at reportaproblem.apple.com, not from us. We can neither issue nor deny an App Store refund.

7.4 Right of withdrawal (EU)

As a consumer in the European Union you have a 14-day right of withdrawal for digital content. By starting the download or immediate use of the content you expressly request its performance and acknowledge that you lose that right once it has been fully performed, under Article 16(m) of Directive 2011/83/EU. This does not affect Apple's refund policy, which may be more favourable.

8. Your content

What you write and log is yours: workouts, notes, routines, custom exercises, measurements, meals and posts. We claim no ownership of it.

To operate online features, you grant us a limited, non-exclusive, royalty-free licence over what you choose to send: to store, copy, moderate and show it only to your selected audience. Private content that remains on-device is not licensed or copied to the server. The licence ends when you delete the content or your account.

9. Community

If you use the social features, you agree not to post content that:

• Harasses, threatens, insults or incites hatred against a person or group.
• Is sexual, violent or illegal.
• Impersonates another person or misrepresents your identity.
• Promotes doping products, illegal substances or dangerous practices.
• Is spam or unsolicited promotion.
• Infringes third-party rights.

You can block users from their profile and report posts or comments inside the App. You can also write to victxrgxnzalez@gmail.com. Automated moderation is applied before posting; it can make mistakes and does not replace report review. We may remove content or suspend accounts that breach this section. Your data is private by default.

10. Acceptable use of the App

You agree not to:

• Access the service through unauthorised automated means, or try to circumvent free plan limits.
• Decompile or reverse-engineer the App except to the extent permitted by law.
• Interfere with the service, overload it, or attempt to access other people's data.
• Resell or redistribute access to TrainUp Pro.

11. Availability

We make reasonable efforts to keep the service running, but we do not guarantee uninterrupted availability. Outages may happen due to maintenance, provider incidents or causes beyond our control. The App keeps working locally during an outage, but Community, purchases and analysis may be unavailable until service is restored.

We may modify, add or remove features. If we remove a significant feature included in Pro, we will tell you in the App with reasonable notice.

12. Termination

You may stop using TrainUp whenever you like and delete your account from the App (Profile → Settings → Account → Delete account). Remember to cancel the subscription separately in iOS Settings.

We may suspend or close an account that seriously breaches these Terms, in particular section 9. Where possible we will warn you first and give you a chance to export your data.

13. Warranties and liability

The App is provided "as is". To the extent permitted by law, we do not warrant that it is error-free or that its calculations are appropriate for your particular case.

Nothing in these Terms excludes or limits our liability for wilful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded. As a consumer, you retain in full the rights granted to you by the mandatory law of your country of residence.

Outside those cases, and to the extent permitted by law, our total liability to you is limited to the amount you paid for TrainUp in the twelve months preceding the event giving rise to it.

Keep copies of what matters to you. Although we sync and back up your data, we are not liable for data loss resulting from not having linked a recoverable account (section 4).

14. Apple

• This agreement is between you and TrainUp, not Apple. Apple is not responsible for the App or its content.
• You are granted a non-transferable licence to use the App on Apple-branded devices that you own or control, subject to the Usage Rules of the Apple Media Services Terms and Conditions.
• Maintenance and support for the App are the sole responsibility of TrainUp. Apple has no obligation whatsoever in that respect.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple will have no other warranty obligation.
• TrainUp, not Apple, is responsible for addressing claims relating to the App: product liability, failure to conform to legal requirements, and consumer protection or data protection claims.
• TrainUp, not Apple, is responsible for the investigation and resolution of third-party claims that the App infringes intellectual property rights.
• You must comply with applicable third-party terms when using the App.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. Changes to these Terms

We may update them. Material changes raise the version number shown above, and the App presents the new text before you continue using it. If you do not accept it, you can stop using the App and delete your account.

16. Governing law

These Terms are governed by Spanish law. If you act as a consumer, this choice does not deprive you of the protection afforded by the mandatory provisions of the European Union country in which you reside, and you may bring proceedings before the courts of your domicile.
